Bail work handled from Kolkata

A bail application is a time-bound piece of drafting. What decides the outcome is not the length of the application but whether the court is satisfied on three questions: whether the accused is required for the investigation, whether he is likely to appear for trial, and whether he will influence witnesses. Everything else — the offence, the antecedents, the amount of money involved — feeds into those three questions.

This office files and argues bail applications before the Chief Metropolitan Magistrate and Bankshall Court, the City Sessions Court, the district courts of West Bengal and the Calcutta High Court. Filing can usually be completed the same day the papers are ready.

The three kinds of bail

What goes into the application

A bail application that is merely a copy of the FIR with a prayer at the end rarely succeeds. The version filed from this office normally contains the FIR and charge sheet (where available), the case diary position on custody, a short statement of the accused's version, documents establishing roots in the community, and a paragraph dealing squarely with the prosecution's likely objections — recovery, previous cases, or the nature of the allegation.

Where the accused has been in custody for some time, the application also addresses the delay in trial and the period already undergone, because courts weigh pre-trial detention against the sentence the offence carries.

Fees and timelines

The first consultation is free. Fees depend on the forum (magistrate, sessions or High Court), the number of accused, and whether the matter will require more than one hearing. Hearings in magistrate courts are usually listed quickly; sessions and High Court listings vary. No lawyer can promise a date of release — what can be promised is that the application is filed correctly, on time, and argued on the points the court actually considers.

Frequently asked questions

How quickly can a bail application be filed?

The application is usually drafted and filed the same day the FIR, arrest memo and remand order are available. Listing depends on the court.

Is anticipatory bail available in every offence?

It is available in non-bailable offences, and is heard by the Sessions Court or the High Court. Certain special statutes restrict it, and the application has to address those provisions.

Can bail be cancelled later?

Yes. The complainant or the prosecution can apply for cancellation if conditions are breached or witnesses are influenced, and the court can also cancel bail on its own.

What does it cost?

Fees depend on the forum and the number of hearings. The estimate is given in writing after the papers are reviewed, and the first consultation is free.

Anticipatory bail and regular bail are different animals

Anticipatory bail is applied for by a person who apprehends arrest but has not yet been arrested. Regular bail is applied for after arrest, and normally before the magistrate who remanded the accused, then before the sessions court and thereafter the High Court. Confusing the two delays the application at the point where it is most needed.

How the application is prepared

The application sets out the complainant's case as disclosed in the FIR, the applicant's position, the previous history of the dispute, and the applicant's roots in the community. The material that carries the most weight is documentary: the order sheet if any proceeding exists, the transaction documents, and, in matters arising from a commercial or matrimonial dispute, the correspondence that shows the dispute is civil in character.

In a matter where the allegation is of an offence punishable with more than seven years, the state may say that custodial interrogation is required. The application then answers that point specifically, showing what material the applicant has already produced and why nothing further can be obtained by detaining them.

What is weighed in favour of the applicant

What a refusal does not mean

A refusal at one stage is not final. Bail can be applied for again before the next court or before the same court on changed circumstances, such as the completion of investigation or the filing of the charge sheet. In practice, applications before the High Court are often made after the investigation is complete, because at that stage the argument that custody is needed for interrogation falls away.
